Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the Zarcall cloud phone system (“Zarcall” or the “Service”), operated by Zarcom Inc. It is incorporated into and part of our Terms of Service. This AUP protects our network, our customers, and the public telephone and messaging networks. It applies to every organization, administrator, and user of the Service.

1. Your responsibility

You are responsible for all activity conducted through your account and for ensuring that your users and anyone you communicate with are treated in accordance with this AUP and all applicable local, state, federal, and international telecommunications laws.

2. Prohibited activities

You may not use the Service to engage in, facilitate, or assist any of the following:

  • Spam calls — unsolicited, bulk, or automated voice calls sent without a lawful basis or required consent.
  • Spam SMS/MMS — unsolicited, bulk, or unwanted text or multimedia messages, or messaging that violates carrier or messaging (10DLC and similar) rules.
  • Unlawful robocalling — prerecorded or automated calling that violates the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, Do-Not-Call rules, or any other applicable law.
  • Fraud — any deceptive, fraudulent, or misleading scheme, including toll fraud, traffic pumping, payment fraud, or impersonation of any person or entity.
  • Phishing — attempts to obtain passwords, financial details, or other sensitive information through deception, including “vishing” and “smishing.”
  • Caller ID spoofing — transmitting false, misleading, or inaccurate caller identification information with intent to defraud, cause harm, or wrongfully obtain anything of value, or otherwise in violation of the Truth in Caller ID Act.
  • Harassment — calls or messages that harass, threaten, abuse, stalk, or intimidate any person, or that are obscene or intended to annoy.
  • Illegal international traffic — routing, generating, or terminating international traffic in violation of applicable law, sanctions, or carrier requirements, or artificially inflating international traffic.
  • Unauthorized account sharing — sharing credentials or access with unauthorized persons, reselling or sublicensing the Service without our written consent, or exceeding the users, extensions, or entitlements assigned to your account.
  • Illegal telemarketing — telemarketing or sales calls and messages that violate the Telemarketing Sales Rule, state telemarketing laws, calling-time restrictions, or registration and disclosure requirements.
  • Unauthorized access — accessing, or attempting to access, any account, system, data, or network without authorization, or assisting others in doing so.
  • Reverse engineering — reverse engineering, decompiling, disassembling, or attempting to derive the source code or underlying structure of the Service, or building a competing product from it, except to the extent this restriction is prohibited by law.
  • Reselling without authorization — reselling, sublicensing, white-labeling, or otherwise making the Service available to third parties without our prior written consent.
  • Network abuse — interfering with or degrading the Service or networks; scanning or penetration attempts; distributing malware; denial-of-service activity; circumventing usage limits or security controls; or any other activity that harms the integrity, performance, or security of the Service.

3. Content and conduct standards

You may not use the Service to transmit content that is illegal, infringing, defamatory, or that violates the rights or privacy of others. You must obtain any consent required by law before contacting individuals by call or message, and you must honor opt-out and Do-Not-Call requests promptly.

4. Enforcement

Violations of this AUP may result in immediate suspension or termination of your account without prior notice. We may also block, filter, or remove traffic that we reasonably believe violates this AUP or applicable law, report unlawful activity to carriers or authorities, and cooperate with law-enforcement investigations. We may take these actions to protect the Service, our other customers, upstream carriers, and the public. Suspension or termination under this AUP does not entitle you to a refund and does not limit any other remedies available to us.
