This E911 Disclaimer explains important limitations of emergency (911) calling when using the Zarcall cloud phone system (“Zarcall” or the “Service”), operated by Zarcom Inc. Please read it carefully. It applies to customers who use United States phone numbers with the Service and is part of our Terms of Service. By using the Service, you acknowledge and accept these limitations.
1. VoIP 911 works differently from traditional phone lines
Zarcall is a Voice over Internet Protocol (VoIP) service. Emergency calling over VoIP does not operate the same way as 911 on a traditional landline. Depending on your configuration and location, a 911 call may be routed differently, may reach an emergency call center that cannot automatically identify your location or call-back number, or may require you to state your location verbally. The Service should not be relied upon as your sole means of reaching emergency services.
2. Internet dependency
Emergency calling requires a working Internet connection. If your Internet or broadband connection is unavailable, congested, or interrupted, or if there is a problem with your network, router, or device, 911 calling may be delayed or may not function at all.
3. Power outage limitations
Unlike a traditional analog phone line, the Service does not operate during a power outage. If your device, network equipment, or Internet connection loses power and you do not have a backup power source, you will not be able to place 911 calls through the Service until power and connectivity are restored.
4. You must maintain an accurate service address
Emergency responders are directed based on the registered address associated with your line or device. You are responsible for registering and keeping current the correct physical address for each line and device, and for updating it whenever you move a device or change locations. If your registered address is missing, outdated, or incorrect, an emergency call may be routed to the wrong emergency call center or responders may be sent to the wrong location. Because Zarcall can be used from any Internet connection, the Service cannot reliably determine your physical location on its own.
5. Your responsibility for emergency readiness
You are responsible for maintaining an alternative means of contacting emergency services, such as a mobile phone or a traditional landline, in case the Service is unavailable. You should inform all users, employees, and others who may use the Service of these 911 limitations, and you should not assume that 911 will function in every situation. We recommend testing your emergency-calling setup and keeping your service address up to date.
6. Limitation of liability
To the fullest extent permitted by law, Zarcom Inc., its owners, officers, employees, and its underlying carriers are not liable for any inability to reach, or any delay or failure in reaching, emergency services through the Service, or for the accuracy of location information transmitted, except to the extent such liability cannot be disclaimed under applicable law. This Disclaimer supplements the limitation of liability in our Terms of Service.
