This SMS Messaging Policy governs the use of text messaging (SMS and MMS) through the Zarcall cloud communications platform (“Zarcall” or the “Service”), operated by Zarcom Inc. It is part of our Legal Center and is incorporated into our Terms of Service and Acceptable Use Policy. When you use Zarcall to send messages, you are the sender and are responsible for complying with this Policy and all applicable law.
1. A2P messaging compliance
Business messaging in the United States is Application-to-Person (A2P) traffic and is subject to carrier registration and rules, including 10DLC brand and campaign registration for local numbers, and equivalent requirements for toll-free and short-code messaging. You must register your brand and messaging use case where required and send only traffic that matches your approved, registered use case. Messaging that is unregistered, misrepresented, or inconsistent with your use case may be filtered, blocked, or terminated by carriers or by us.
2. Consent requirements
You must obtain and maintain records of the recipient’s prior express consent to receive messages before sending, consistent with the Telephone Consumer Protection Act (TCPA) and carrier rules. Consent must be specific to the type of messages you send, must not be a condition of purchase for marketing messages, and must not be bought, sold, or transferred. You are responsible for honoring the scope of the consent you obtained.
3. Opt-in
Recipients must clearly opt in to your messaging. Your opt-in must identify your business, describe the type and purpose of messages, and disclose message frequency, that message and data rates may apply, and how to get help or opt out. Keep evidence of each opt-in.
4. STOP and HELP keywords
You must support standard keywords. Replying STOP (and similar opt-out words) must immediately unsubscribe the recipient, and you must stop messaging that number. Replying HELP must return your business name and support contact information. Do not attempt to bypass, discourage, or override opt-out requests.
5. Message frequency and content
Send only the messages the recipient agreed to, at a reasonable frequency, and only during permitted hours. Do not send prohibited content, including messages related to unlawful activity, or content prohibited by carrier rules (often referred to as “SHAFT” — sex, hate, alcohol, firearms, and tobacco — where restricted). Prohibited and abusive messaging is also covered by our Acceptable Use Policy.
6. Carrier disclaimer
Message delivery depends on upstream carriers and mobile networks that are outside our control. We do not guarantee that any message will be delivered, delivered on time, or delivered without filtering. Carriers may block, filter, throttle, or reject messages at their discretion, including for compliance or spam reasons. Message and data rates may apply for recipients.
7. Customer responsibilities
You are solely responsible for: the content of your messages; obtaining and documenting valid consent; complying with the TCPA, CAN-SPAM, Telemarketing Sales Rule, Do-Not-Call rules, A2P/10DLC registration, and all applicable local, state, federal, and international laws; honoring opt-out and HELP requests; and maintaining accurate sender information. You agree to indemnify Zarcom for claims arising from your messaging, as described in our Terms. Violations may result in immediate suspension or termination under our Terms and Acceptable Use Policy.
